I've had it happen many times, sometimes after playing a spell or a creature, sometimes before attacking.
Ive been credited with a win when I was losing, a loss while winning, and vice versa.
If you can catch the fact that the game is ending due to some problem and apply a winner seemingly at random, perhaps instead you could give both players the win or give no one the win and don't apply the losing penalty
