scute swam copy
i had phyresis roach and gave scute swarm perpetually toxic 1. However when creating a copy of itself via playing lands it's copy didnt have toxic 1.

Of course not. Like any other non-layer 1 effect, granting the toxic ability, as a layer 6 effect, is not copyable. Perpetual only makes an effect persist over zone changes, it does not change the layer system or make an effect change copyable values.
